Starbucks Suing Bangkok Coffee Cart Owner

Thai authorities are considering a call from Starbucks, the kaisers of corporate coffee, to arrest the owners of a hand-pushed coffee cart with a curious name.

In papers filed yesterday with the Central Intellectual Property and International Trade Court, Starbucks asked the court to order the arrest of the owner of coffee stall “Starbung” and his brother as part of an ongoing copyright dispute.

The U.S. coffee chain also wants the men find THB300,000 plus interest.  Starbucks has thrown the book at the men, who operate the single cart in the Rattanakosin district of the Thai capital.

No morning hardon?  Then have a cup of One Fan coffee!   :character00274:

29 October 2013, Last upated at 22:32 GMT Police Seized Viagra Coffee

(29 October) A collaborated team of Metropolitan Police Bureau and Representative from Food and Drug Administration (FDA) seizure coffee claimed to have contained Viagra.

The team had conducted a search at a company in Kannayao district, Bangkok on Tuesday morning after the search warrant was issued by Minburi Provincial Court.

Several reports were made against a coffee brand ‘One Fan’ (Thailand) for mixing the illegal Sildenafil substance in their coffee.

Prior to the search, police claimed they had taken the sample of the coffee to be tested by the Department of Medical Science. The results then yielded that the coffee contains Sildenafil substance, which is commonly known as Viagra under its trade name.

Mr. Paitoon Saengseenil, a co-founder of the company, said that his company is only responsible for retailing the coffee, and has not been engaged in the manufacturing process of the coffee.

According to Mr. Paitoon, the company was under the governing of Saha Mang Khang Group. The man also denied knowing any clues about the containing of the illegal substance in the coffee.

Police then seized 66,264 packages of the coffee found at the scene worth no less than THB 3 million.

The items taken during the seizure will be tested again. However, if the test bares the same result, the manufacturing company will be facing charges for adding illegal ingredients into their food. The company may face up to two year in prison and no more than THB 20,000 fine.

Starbung, the local coffee cart in Bangkok’s Rattanakosin district that appropriated Starbucks branding, has backed off from a legal fight with the American coffee giant, which filed a lawsuit for using its logo’s likeness in September.

Damrong Maslae, the cart’s 43-year-old barista, has reportedly changed his logo from "Starbung Coffee" to "Stylebung Tea-Coffee" with a slight change of the color scheme. His new logo has been passed around social networks for two weeks,  with many admiring the street vendor for his sneaky and free PR strategy.

Damrong and his brother failed to show up for trial yesterday at the Central Intellectual Property and International Trade Court for the arrest request by Starbucks for copyright dispute.

But Damrong’s lawyer was there to represent him and presented a photograph of the new Stylebung logo to the court. The photo, taken the day before the trial, seems to have protected Damrong and his brother from prison, as the court declined to arrest the defendants and will recall them for reconciliation between the two parties on Nov. 18.

However, the additional lawsuit Starbucks filed for violating Articles 109 and 110 of the Thai Trademark Act B.E.2534, which would require the coffee stall to pay damages of THB300,000 with 7.5% interest is still in play. The case is set to go on court on Feb. 10, 2014.
